Enhancing its privacy and copyright policies, Instagram has now stated, according to which the users now need permission to use someone’s Public photos on Instagram. The photo-sharing app said that now in case someone embeds another user’s Instagram post photos on any third-party website. They need to take permission from the original poster else to be ready to face copyright infringement laws.
Public Photos not Sublicensed with Embed API as Per Instagram
Recently Instagram has faced flak after a lawsuit has been filed between Newsweek and a professional photographer. Instagram allows users to embed posts and photos of the account made Public on various websites. However, it has made clear that the app does not permit you to use someone else’s photos without permission. In case you need to use someone’s public images, you need to seek their approval.

Newsweek did not get the license of the photograph posted by McGuckin; however, it merely embedded his post on their website. When the row began, they cited that Instagram Terms if Service allows the sublicense for the various users on Instagram.

Seek license before using posts
Instagram has now made it clear that the sublicense is not granted when you embed the API. It adjudicates that the users need to ask for permission and even take licensing if required from the Instagram user who posted the photograph originally.

“While our terms allow us to grant a sub-license, we do not grant one for our embeds API. Our platform policies require third parties to have the necessary rights from applicable rights holders. It includes ensuring they have a license to share this content if a license is required by law.”
